To dispel some confusion, you should know that a Medigap policy is not the same as a Medicare Advantage Plan. The latter helps you receive Medicare benefits, while the former supplements the benefits you obtain through your Original Medicare plan. As you begin to explore Medicare Supplement Insurance Plans, keep the following important information in mind:

  • To qualify for a Medigap policy, you must first have Medicare Part A and Medicare Part B.

MYRTLE BEACH, S.C. (WPDE) — A Myrtle Beach resort will pay a North Carolina family $26 million to settle a lawsuit filed after their three-year-old son endured severe chemical burns after swimming in the resort's pool.

The story of now seven-year-old Ashtyn Douglas is one we've been following since the beginning.

When then-three-year-old Ashtyn went swimming in the Caribbean Resort and Villa's lazy river in 2020, neither he nor his parents could have predicted how that very plunge would alter his life forever.

The prosecuting attorney for the family Kenneth Berger said following the incident, Ashtyn spent seven days at the UNC Burn Center.

Ashtyn is gonna live with this the rest of his life," Berger said. "Ashtyn is never going to forget, so the people who caused it should never forget either.

He said Ashtyn is still undergoing scar treatments to this day.

“He’s undergone at least five laser treatments and our prayer for Ashtyn is that as he makes it through middle school, high school, and hopefully college, that it’s not any worse than it has to be. You already have bullies out there. You already have this 24/7 social media. It used to be when you went home you were done with it. And now with social media and our fear for Ashtyn, is once other children learn about his injury, or learn about his scars, that there’s going to be a 24/7 cycle that he can’t escape. He’s still undergoing scar treatment at MUSC’s Burn Center," Berger said.

Ashtyn suffered permanent scarring below the waist after encountering dangerously high chlorine levels in the resort's pool, according to Berger.

"The biggest concern is what it’s gonna do to him long-term. You know you think about the first time he’s in a locker room, what middle school is going to be like, what high school is going to be like," he said.

According to the South Carolina DHEC, public pools must provide a daily operation report documenting chlorine and pH levels. But Berger said former Caribbean Resort employee Juan Rivera falsified those reports.

“Juan Rivera was arrested for forging the pool documents. I don’t know where he is now, but one of the surprising things about this case is even after he admitted to falsifying the logs under oath, Caribbean Resort still didn’t fire him until we sent them a request asking when his last day was, when he’d been terminated. We sent out that request more than a month after his deposition. It wasn’t until after they received it, they finally took action and let him go," he said.

ABC15 asked Berger why he thinks the resort didn't immediately terminate Rivera.

He responded that that's one of the big questions in this case.

What we learned was that under the law, the pool should not have even been open that day because the logbooks weren’t in compliance," Berger said. "What the law says is that if those pool chemical logbooks are not in compliance, you’re not supposed to open the pool. The pool should have never, ever been open. Ashtyn should have never gotten those chemical burns.

Why they didn’t immediately let him go after we uncovered the fact that he had been falsifying the logs was one of the big questions that we had in this case. Another thing we learned was even three years after Ashtyn got burned, the pool chlorine levels still weren’t in compliance.

Berger said he spoke with Rivera's department head and asked about those pool logs.

“You had someone who was in charge of the pools who was breaking the law. You had his supervisor when asked if he’d like to know how many times those records had been falsified before Ashtyn got in the pool, his answer was quote, ‘No, I don’t really care.’ And then you had the department head pleading the 5th Amendment more than 20 times when asked about those pool logbooks," he said.

According to South Carolina law, a resort's chlorine levels cannot be over eight on a test strip.

The laws are in place to protect our most vulnerable. To protect children, to protect the elderly. That’s why these chlorine laws are in place," Berger said. "That’s why pool safety laws are in place. In this instance, they were so flagrantly and repeatedly violated that something had to be done. We disposed Juan’s department head and asked him about the pool logs. He pled the 5th Amendment more than 20 times. This wasn’t just Juan Rivera.

In Ashtyn's situation, Berger said the Caribbean's chlorine levels were off the charts.

Berger and the Douglas family hope Ashtyn's situation will be a reminder and cautionary tale for the hospitality industry to protect those in society who are most vulnerable.

“It’s January right now. My hope is that when we get to tourist season, in fact, I hope before then, that the industry takes notice. That not just these defendants, but all Myrtle Beach resorts, all South Carolina resorts. All resorts across the country take notice and institute positive changes that reinforce and prioritize safety above all else. Children’s safety should be resorts’ absolute number one priority," Berger said.

Berger said the family is now focusing their efforts on making sure this doesn't happen to anyone else's child.

“One of the things we learned in this case is that the GM referred to the pools as the money maker, and that’s great, they should be able to make as much money as they want. But they have to do it safely. If you’re going to invite families, if you’re going to lure families to your resorts with pools and great deals, for God's sake make sure they’re safe," he said.

“Hello your food is here,” a feminine voice purrs from it’s speakers as the robotic server, pointed ears glowing blue and red, approaches the table.

Reach out and touch one of those glowing ears, and “Bella” or “Bobby,” the names given to these feline androids will respond with a wink of the eye on the whiskered display. “Don’t touch my ears, just pet my head.” The friendly bot emits a little giggle to let you know it’s just joking.

The robotic “food runners” are closely followed by human restaurant staff members who carefully move the meals from the bots four shelves and distribute the food to the customers.

The two Bellabots developed by the ToDo Robotics company have recently arrived on the Myrtle Beach dining scene, where they are making a big impression on visitors, according to Adela’s manager Alejandro Navarrete.

“We have had a big response.” he said, “Kids love it and they keep bringing families back.”

Adela’s Mexican Kitchen first introduced the robots at their Lancaster, South Carolina location and now have them in all three restaurants including North Myrtle Beach, and Waxhaw, North Carolina.

According to the ToDo Robotics website, the Bellabots use 10 cameras and lidar to navigate their way around busy restaurants, their sensors helping them avoid collisions and find their way to programmed tables.

Using artificial intelligence, the robots can interact with customers with hundreds of vocal responses and graphic facial expressions.

Navarrete says that in addition to their entertainment value, the robots provide for additional safety for his staff by carrying hot plates that may burn human hands. The bots also make his staff’s job easier by carrying eight plates at time reducing their number of trips in and out of the kitchen.

While response to the cat bots have been mainly positive, Navarrete says he has seen some social media posts concerned that automation could replace server positions.

Navarrete insists that is not what is happening in his restaurant. “It’s another tool for my crew,” he said.

Stars and Strikes Getaway-n-Play, an entertainment complex that opened last year at the Coastal Grand Mall is also using new technology to entertain and serve.

The high-tech facility reportedly costs $10M and features laser tag, arcade games, bowling, and ax throwing, allowing visitors to make food selections via large touch screens in their entertainment areas.

The refreshments are then delivered to the table or bowling lane by their own pair of feline Bellabots.

In addition to Adela’s and Stars and Strikes, a recent TikTok video shows Dumpling and Seafood in Myrtle Beach using one of their Bellabots to deliver food and the restaurant staff confirms that they have single robot server on duty at their location in the Galleria Shopping Center off Lake Arrowhead Road.

The Mura Restaurant, Bar & Cafe, will serve Korean-inspired small plates, along with teas and cocktails via a conveyor belt that runs around a central bar.

Diners will pick small plates of Asian favorites right off the moving conveyor as it passes. Their plates, ranging from $4 to $11 a piece, are then tallied and added to a tab.

General manager Sung Chun told The Sun News that the conveyor belt will be the first of its kind in the Myrtle Beach area.

Chun said the concept was “just for people to have fun, like, you don’t know 100% what’s to be expected.”

People living in Arkansas, Delaware, Louisiana, Minnesota, New Jersey, Washington and Wisconsin were most drawn by the waterfalls.

Continuing to show Americans’ love of the great outdoors, the Grand Canyon was the third most searched tourist attraction — with residents living in Idaho, Indiana, Oklahoma, Rhode Island and South Dakota most interested in exploring the expansive natural wonder.

Meanwhile, those living in New York, California, Michigan and West Virginia were more interested in visiting historic and cultural sites — the Museum of Modern Art, Alcatraz Island, the Statue of Liberty and Mount Rushmore, respectively.

MYRTLE BEACH, S.C. (WBTW) — A South Carolina resort will pay $26 million to settle a federal lawsuit filed after a 3-year-old suffered serious chemical burns in a pool, attorneys for the family said in a news release.

The incident happened over the 2020 Memorial Day weekend while the family was visiting Myrtle Beach’s Caribbean Resort, operated by Brittain Resorts.

According to the law firm Trial Lawyers for Justice, 3-year-old Ashtyn Douglas’ injuries were caused by a swimming pool that had “dangerous and illegally high levels of chlorine.”

“The resort looked beautiful, the resort looked safe,” attorney Nicholas Rowley said. “But what was in the water was not only dangerous but illegal.”

The lawsuit alleged that the chlorine level records provided to the South Carolina Department of Environmental Control had been falsified for multiple years.

The family first noticed Ashtyn’s symptoms after leaving the resort to return home, the attorneys said. His condition became worse over several hours before his parents took him to a pediatrician the next morning.

“As a 3-year-old, you don’t understand why it is that you’re in pain, why it is that you’re hurt,” Rowley said. “He was admitted to the hospital for a week where they treated his burns and then had to debride him.” Debridement is defined as the removal of dead tissue from wounds.

Ashtyn was eventually admitted to the University of North Carolina Burn Center, where he was treated for a week, attorneys said.

Ashtyn’s family later contacted DHEC, suspecting the burns came from exposure to elevated chemical levels in the resort’s pool, attorneys said. DHEC subsequently shut the pool down after testing showed dangerously high chlorine levels.

“This corporation and its insurance companies refused to settle this case year after year and refused to accept responsibility for what happened to an innocent little boy,” Rowley said. “The conduct and reckless disregard for the rights and safety of children and their families at this resort was egregious.”

Rowley said in his statement that the resort’s logbook showed normal levels on both days the child was in the pool but that an investigation revealed that a resort worker certified in pool operation filled in data on days that he wasn’t working, including the one when the child was burned.

“This record-setting settlement will not only fully compensate a little boy and his family but will send a powerful message to corporations across the country that callous disregard for the rights and safety of resort guests and children has big consequences,” Rowley said.

Rowley said the jury trial would have been sometime in late spring or summer if the resort hadn’t agreed to pay.

“The one thing that this family has not heard is ‘I’m sorry,'” he said. “The reason why this family brought this case is to make sure this didn’t happen to anybody else, especially another child.”

Recipient of the ACCSC 2020 School of Distinction, PIA’s Myrtle Beach Campus is located at the International Technology and Aerospace Park, near South Carolina’s Myrtle Beach International Airport. PIA’s airport location provides an ideal atmosphere for aviation training as well as aircraft accessibility to the school’s facilities.

The 26,000 sq ft facility houses classrooms, a learning resource system with a mobile computer lab and publications library, and shop areas for aircraft propulsion systems, electricity, sheet metal, hydraulics, instruments & controls, composite materials, non-destructive testing, and painting.
